1. The first special ground of the motion for a new trial urges that the trial court erred in explaining one of the contentions of the defendant to the jury in the following language: "Denies that . . . denies all other paragraphs of plaintiff's petition and further alleges that Stanley . . . the other defendant . . . was driving his automobile at the time and place alleged in the petition when suddenly there appeared a truck driven by a named person...
