On the evening of June 14, 1960 Kathleen M. Scaggs was struck from behind by a taxicab at a street intersection in Silver Spring, Maryland, just as she was stepping upon the end of a concrete island in the middle of a dual highway. Her case was tried before a jury and resulted in a verdict and judgment in her favor for injuries suffered in the sum of $3500.
