Appellant was indicted for robbery, the indictment alleging that he took two dollars from Charles Don Nichols on or about February 8, 1961.

The indictment was returned February 15, 1961, and on the following day appellant waived a jury and, joined by his court appointed counsel, waived the 10 days allowed by statute to prepare for trial. Appellant gave his age as 17,...
