This is an appeal by A. R. Stowe, a suspended policeman, from a summary judgment in favor of the City of Corpus Christi.

The evidence reveals that police officers of the City of Corpus Christi were on routine patrol on the night of February 24, 1959, when they saw officer Stowe emerging from the Village Liquor Store.
