This is a trespass action which was tried before the writer of this opinion and a jury and resulted in a verdict for plaintiff in the sum of $2,500. Plaintiff filed a motion for a new trial on the ground of inadequacy, and after argument before the court en banc, a new trial was granted. Defendant has appealed to the Superior Court, and this opinion is written in accordance with rule 43 of the Superior Court Rules.
