This suit was brought in the District Court for the Southern District of Georgia by the United States1 to recover penalties assessed against appellee by the Secretary of Agriculture under the Agricultural Adjustment Act of 1938, as amended 7 U.S.C.A. § 1281 et seq. A summary judgment was entered below for appellee and the government has appealed therefrom.
