This is a suit by Fireman's Fund Insurance Company to recover from defendants, Nola Cabs, Inc., and James Short, the sum of $5,324.53, admittedly paid by the plaintiff to Anthony Milone as compensation benefits. Plaintiff is the workmen's compensation insurer of Russell Ice Cream Company, employer of Milone.
