DYER, Justice.

Clyde Rogers, age 49 had been employed by the Aluminum Company as a guard for about seventeen years. In his original petition filed October 24, 1958, amended March 13, 1961 against the Company to secure alleged benefits due him under our Workmen's Compensation Statutes he alleged an accidental injury in the lowering of a tight window while on duty alone in a guard station (small building) on March 24, 1958: that as a result of this accidental injury...
