In an action for an accounting, the plaintiff in two concurrent motions seeks (1) to modify the defendant's demand for a bill of particulars by striking all the items therein except items 2, 10, 17 and 19 and (2) for summary judgment. The defendant cross-moves to dismiss the first, second and third causes of action in the complaint for legal insufficiency.
