This is an action for damages for alleged malicious prosecution. Plaintiff was prosecuted for larceny of a large copper cooler, referred to in the record as a tuyere, the complaint being signed by John Davis, defendant's plant protection chief. Davis was joined as a party defendant in the instant case but on stipulation the action was dismissed as to him.
