Mary Horner was a passenger in an automobile owned by Ben Fallender and being driven by his son LeRoy. It was involved in a collision with a truck driven by James Maclin, as a result of which Mary sustained injuries. In her action for damages she recovered judgment upon a jury verdict for $14,000 against the Fallenders and $6,000 against Maclin. All of the defendants appealed but after the appeal was perfected the Fallenders satisfied the judgment...
