Edward James Skebeck, while riding as a passenger in an automobile operated by Edward Harry Carroll on November 29, 1959, was instantly killed in an accident. Letters of administration were granted to Frances Ann Stoltz, who, as administratrix of the estate of decedent, filed an action in trespass against defendant, Edward Harry Carroll, on November 29, 1960. The complaint was served on defendant December 5, 1960.
