Appellant-plaintiff, J.B. Nedd, filed his complaint seeking partition of five parcels of land in which he asserts his claim as the surviving spouse of Agnes Rubin Nedd, deceased. The Administrator de bonis non of the estate of Agnes Rubin Nedd, W.J. Oven, Jr., has been joined as a party plaintiff.
