This is an appeal from a judgment of conviction of burglary in the second degree and grand theft, and an order denying a motion for a new trial.

In an amended information filed on April 27, 1961, the defendant was charged in count 1 with burglarizing the office of the John Hancock Oil Company in Long Beach on January 23, 1961; in count 2 he was charged with grand theft from John Hancock Oil Company on January 23, 1961.
