Of all of the litigation arising under the Natural Gas Act, this is a most unusual case. The first, at least of recent vintage, and perhaps the last of its kind, it does not really challenge an order of the Federal Power Commission as such. What is involved is a settlement agreement — a voluntary settlement contract made by parties in an adversary position, and thereafter approved by the Commission as the basis for tariff rates...
