Plaintiff brought this case under the provisions of the Tucker Act, 28 U.S.C. § 1346(a) (2), and the Federal Tort Claims Act, 28 U.S.C. § 2671 et seq., alleging that by the construction of an irrigation and drainage project in the Helena Valley in Montana through its Bureau of Reclamation, the defendant had drained some springs and in effect had deprived plaintiff of an appropriated water right of 80 miners inches of water which flowed...
