FROST, Justice.

This is an action of trespass on the case for negligence which was tried to a jury which returned a verdict for the defendant. The trial justice denied the plaintiff's motion for a new trial and the case is here on his exception to such denial and on exceptions taken during the trial.

In the summer of 1957, building 100, so called, one of the buildings of the Rhode Island College of Education, was being constructed in the town of North Providence...
