Plaintiffs Thomas Carrick, Thomas Daly, and Maude Bessey, as the surviving widow of Harry Bessey, brought this action to obtain a judicial declaration that all three men had been improperly retired, under the Charter of the City and County of San Francisco, as miscellaneous employees rather than as members of the fire department; also, that they were entitled to a refund of all sums deducted from their salaries for pension purposes.
