This is a suit by a former employee against his former employer to recover a stipulated "drawing account" not paid to him during the period of his employment. The defendant appeals from adverse judgment.

The employee was to receive a percentage of the net profit of the firm as compensation for his services, and his drawing account was to be charged against it. The question before us concerns whether the employer is nevertheless liable for such...
