The defendant appeals from a conviction of the crime of robbery (ORS 163.280).

There are five assignments of error. The first alleges that there was a failure of proof.

The indictment charged that the defendant "* * * being armed with a dangerous weapon, to-wit, a pistol, * * * did commit an assault upon one Joseph A. Steiert by pointing said pistol at and toward the said Joseph A. Steiert in a threatening and menacing...
