The record discloses the following facts: On December 10, 1959, at about 2:45 p. m., Maureen O'Brien had stopped her 1957 Chevrolet in traffic behind a long line of cars at an intersection with her foot on the brake. While her car was in a stationary position it was struck from the rear by an automobile driven by the defendant Fred H. Yaeger.
