NORTHCUTT, Justice.

This is a workman's compensation suit in which appellee, Uhlon Glenn Waters, was plaintiff and appellant, Texas Employers' Insurance Association, was defendant. On findings of the jury that on the 20th day of June, 1960, plaintiff was injured and suffered total and permanent incapacity, the trial court entered judgment accordingly.
