In an indictment the defendant was accused, in two counts, of unlawfully selling marijuana. He admitted an allegation of the indictment that he had been convicted previously of violating section 11500 of the Health and Safety Code, a misdemeanor. In a jury trial he was found guilty on both counts. He was sentenced to state prison for the term prescribed by law, with the direction that the sentences on the two counts run concurrently.
