Plaintiff in error will be referred to as defendant.

The defendant was accused with one Solis of burglary (C.R.S. '53, 40-3-6) and conspiracy to commit burglary (C.R.S. '53, 40-7-36). Trial resulted in a verdict of guilty against each defendant on both counts. Defendant was sentenced to the State Penitentiary for a period of not less than three nor more than five years. Although conviction was had on both counts, only one sentence was imposed...
