OTIS, JUSTICE.

The defendant, George A. Polk, and an accomplice, one Robert Whitman, were charged and convicted of forgery in the second degree in the District Court of Hennepin County. Whitman pleaded guilty to the offense and was placed on probation. Defendant was found guilty after a jury trial and on March 8, 1960, was sentenced to the State Reformatory for a term not to exceed 10 years.
