Plaintiff commenced an action against defendant on April 25, 1959 to recover a judgment for injuries sustained in an automobile accident which occurred on February 14, 1959. On May 11, 1959, defendant answered the complaint and demanded a bill of particulars. Plaintiff failed to comply with the demand and on defendant's motion an order was granted on June 26, 1959 to preclude plaintiff from giving evidence...
