On May 2, 1957, Mayo L. Priebe, Sr., and two others became incorporators of Mayo's Drug and Cosmetic, Inc., defendant here. In October 1957 plaintiffs brought this suit to enjoin said defendant from the use of the name "Mayo" and all of its variants...
