HAWTHORNE, Justice.
This court granted a writ in this case to review the judgment of the Court of Appeal, Fourth Circuit, which affirmed an award to plaintiffs of $4500.00 for damages under the penalty provision of an agreement to purchase and sell real estate. This award of damages was made on the theory that the prospective purchaser had breached the contract by failing to make the required deposit of $4500.00.
