We entertain this appeal from a judgment of the Court of Common Pleas of Summit County, in which it is claimed that the trial court committed prejudicial error in arresting the testimony of the litigants from the consideration of the jury and entering judgment for the defendant. The plaintiff in the court below is obviously the appellant here.
