William H. Ferrell, as a result of injuries he sustained when Rodney W. Beddow struck him with a vehicle he was operating, instituted an action at law against Beddow for damages. Beddow filed a plea in abatement to the jurisdiction of the court, alleging that sole jurisdiction rested in the Industrial Commission under the Virginia Workmen's Compensation Act.
