JORDAN, Judge.
E. M. Rogers, Jr., filed suit on open account against M.S. Sirmons in the Superior Court of Lanier County. The defendant in his amended answer denied the indebtedness and the case proceeded to trial on its merits, the jury returning a verdict for the plaintiff. The defendant's amended motion for new trial was denied and he excepted to that judgment, bringing the case to this court for review. The plaintiff below died after the writ of error was filed...
