This is an appeal in an action for damages to personal property. Noel Cover, the appellant, was the plaintiff in the lower court. Platte Valley Public Power and Irrigation District, the appellee, was the defendant.

In 1947 the plaintiff, with Armour and Company, was engaged in feeding sheep at a feed yard near Cozad, Nebraska. The feed yard is located about a quarter of a mile west of a draw or swale which runs generally north and south...
