Plaintiffs, husband and wife, brought this suit for damages as a result of injuries suffered by plaintiff wife at the Vernon Theater in Leesville, Louisiana, on June 11, 1958, when she sat in a seat without a back and fell backwards. The insurer of the Vernon Theater, The Indemnity Insurance Company of North America, was named defendant.
