This action was commenced by the appellant on August 7, 1957, by the filing of his complaint alleging a cause of action under the Indiana Guest Statute, in the Washington Circuit Court for damages growing out of the injuries to and the death of William Gene Roop, on behalf of alleged dependent next of kin.
