On its face, this case comes to us as an action upon a life insurance policy by the widow as the beneficiary.1 The policy had been issued without a medical examination on the basis of representations made in the application signed by the insured. The application was made May 20, 1959 (and policy was issued as of that date), and death occurred February 3, 1960, of a myocardial infarction...
