This suit was brought by appellee, Dixie Brown, owner of an undivided ¾ths interest in Tract 231 of Subdivision No. 13 of Brazos Coast Investment Company's Subdivision out of the A. Calvit Survey, Abstract 49, in Brazoria County, Texas, against the Houston Pipe Line Company for a mandatory injunction requiring appellant to remove its high pressure gas pipeline from said premises, and, in the alternative, for damages and exemplary damages.
