Plaintiff, an enlisted man in the Air Force, seeks judgment for pay and allowances from the date of his allegedly unlawful discharge.

Plaintiff re-enlisted in the United States Air Force on December 7, 1955. On November 16, 1956, plaintiff was convicted by a civil court of the State of Oklahoma, after a trial without jury on a plea of guilty, of the crime of rape in the second degree, and was sentenced to serve a term of five years' confinement...
