Daniel R. Wolfe, defendant herein, was tried by the court without a jury on an indictment returned by the June 1961 grand jury, charging that on or about December 31, 1960, he did, with intent to defraud, knowingly and wilfully utter and pass to one Mildred Ballinger approximately thirty-three falsely made, forged and counterfeited obligations of the United States ($5 bills), in violation of Section 472, Title 18 United States Code.
