The accident, out of which this litigation arose, occurred July 26, 1958, about 2:30 a. m. in Louisville, Kentucky, about 150 to 200 feet south of the intersection of First and Oak Streets. First Street runs north and south and all vehicles involved in the accident were headed south on First Street.
