The offense is murder without malice (Art. 802c Vernon's Ann.P.C.); the punishment, 3 years.

The evidence shows that appellant was driving a Cadillac automobile; that he failed to stop at a stop sign at an intersection, and without reducing his speed ran into the side of the Chevrolet automobile driven by Donald R. Higgenbotham; that Higgenbotham died several weeks thereafter as a result of the injuries he received in the collision...
