Memorandum:

Petitioner operated a bar and restaurant in Cassadaga, New York. The licensee was absent on May 7, 1961 and his wife was in charge. On the morning of that day, there were a number of patrons in the bar and more in the adjacent dining room. About 12:45 A.M. a scuffle occurred among four individuals in the dining room. Mrs. Arp ordered the participants to leave. They shook hands and the trouble ceased...
