This appeal from a judgment for defendant in a personal injury action is now before us on rehearing. It was presented originally upon a clerk's transcript and a partial reporter's transcript; we found substantial error but due to the abbreviated record were not able to determine whether it was prejudicial to the extent of working a miscarriage of justice.
