Charged in Count I of an information with murder (Pen. Code, § 187) of Richard Ortega, on July 30, 1961, and in Count II with assault with a deadly weapon (Pen. Code, § 245) committed upon Raul Navarro on the same date, defendant after a nonjury trial was convicted of voluntary manslaughter on Count I and assault as charged in Count II.
