Petitioner was convicted of burglary in the third degree on April 12, 1948 and given a reformatory sentence with a maximum of five years. He was paroled on June 12, 1950. While on parole he was convicted of vagrancy on February 23, 1951, and was charged with parole violation. On March 22, 1951 he received a suspended sentence on the vagrancy charge and was lodged in the Albany County Jail.
