Defendant was convicted after a jury trial of the crime of escape from a state prison, in violation of Penal Code, section 4530. He has appealed from the judgment of conviction.

The evidence indicates that on June 27, 1958, defendant was serving terms in the Chino State Prison for armed robbery and assault with a deadly weapon. On that day he was sent to work in a hayfield with a crew of prisoners under the charge of Correctional Officer Carpenter...
