The trial court dismissed plaintiff's suit for workmen's compensation and the plaintiff has appealed.

The pleadings in this case disclose that the plaintiff was an automobile service station attendant for seven months with the same employer prior to November 25, 1958, the date on which he claims to have had an accident injuring his back.
