MOORE, Justice.

Plaintiff in error, to whom we will refer as defendant, appears pro se. He was charged, by information filed in the district court of the City and County of Denver, with having possession of Cannabis Sativa L. (marijuana). He entered a plea of not guilty and after trial to a jury was found guilty as charged. On March 9, 1960, he was sentenced to a term of not less than five nor more than ten years in the state penitentiary.
