McDONALD, Judge.

Appellant was convicted in the County Court of Van Zandt County for driving a motor vehicle on a public road, while intoxicated. His punishment was assessed at a fine of $100 and confinement in jail for thirty days.

The witness Saxton testified that on the night of July 4, while at home, he heard a noise which sounded like a "car collision" and went to investigate, and that he observed an automobile sitting "crossways" about four or five feet...
