This is an action under the Miller Act, 40 U.S.C.A. §§ 270a and 270b, wherein the "use plaintiff" sues to recover $63,433.03 for painting, filling and taping work which plaintiff says it performed as subcontractor of the prime contractor, Peter Kiewit Sons Company of Canada Limited, on a certain building project of the United States. A contract was entered into on May 20, 1958, between the prime contractor and the United States...
