The defendant was accused of the crimes of kidnapping and statutory rape of a 14-year-old girl. He pleaded not guilty, waived his right to a jury trial and was found guilty as charged. On appeal from the judgment of conviction he contends there was reversible error in that (1) at the preliminary hearing the magistrate failed to exclude the investigating officer and the mother of the prosecutrix from the courtroom upon defendant's motion for the exclusion...
